Terms of use

The agreement between you and The Apptor when you use Nowmark: Timestamp Camera, including Nowmark Pro.

Effective 30 October 2026

1. The agreement

Nowmark: Timestamp Camera ("Nowmark", "the app") is published by The Apptor ("we", "us"). By downloading or using the app you agree to these terms. If you do not agree, please do not use it. Our privacy policy explains how we handle data.

2. Using Nowmark

We give you a personal, non-exclusive, non-transferable licence to use Nowmark on devices you own or control, under these terms and the rules of the store you downloaded it from. You agree not to:

  • use the app to break the law, including laws on privacy, recording people and taking photos in restricted places;
  • use stamps to mislead people, for example by passing off an edited date, time or place as what your phone recorded;
  • copy, modify, reverse engineer or resell the app, except where the law allows it;
  • interfere with the app's purchase checks or try to unlock Pro without paying.

3. What a stamp shows

The date, time, address, coordinates and accuracy on a stamp are what your phone reported when the photo was taken, or what was stored in a photo you picked from your library. Addresses are looked up from coordinates and can be a street or two out, especially indoors or with approximate location. You can also type your own place name and change the date and time on photos you import.

A stamped photo is a clear record, but it is not certified or tamper-proof evidence of time or place. Whether it is accepted by a client, insurer, court or anyone else is up to them. Check the stamp before you rely on it.

4. Your photos and notes

Your photos, notes, logos and other content belong to you. They stay on your device and we do not receive them. You are responsible for having the right to use any logo or company name you add, and for the photos you take and share. Keep your own backups: if you delete the app or lose your phone, content kept only in the app is lost with it.

5. Nowmark Pro subscriptions

The free version of Nowmark includes the camera with date, time, location and note stamping, the Imprint, Field card, Strip and Corner styles, auto-save, records, stamping single existing photos and reminders. These free features stay free.

Nowmark Pro adds company name and logo, job reference and "taken by" fields, the Ledger and Badge styles, unlimited presets and batch stamping of up to 50 photos. It is an auto-renewing subscription:

  • Plans: weekly, with a 7-day free trial where offered, or yearly. The price and any trial are shown in the app before you buy.
  • Billing: payment is taken by Apple (App Store) or Google (Google Play) from the account you buy with, when you confirm the purchase, or when a free trial ends.
  • Renewal: your subscription renews automatically at the same length and the current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
  • Free trials: if you cancel during a trial at least 24 hours before it ends, you are not charged. If you do not, the subscription starts and is charged when the trial ends. Any unused part of a trial is lost when you buy a subscription.
  • Price changes: Apple or Google will tell you about a price change before it applies, under their rules.

6. Managing and cancelling

Subscriptions are managed by Apple or Google, not by us. You can turn off auto-renewal at any time:

  • iPhone or iPad: Settings, tap your name, then Subscriptions.
  • Android: Google Play, tap your profile picture, then Payments and subscriptions, then Subscriptions.

Deleting the app does not cancel a subscription. After you cancel, Pro stays active until the end of the period you have paid for.

7. Refunds

Refunds are handled by Apple or Google under their policies; we cannot issue them ourselves. On iPhone, request one at reportaproblem.apple.com. On Android, see Google Play's refund help. Nothing in these terms affects your legal rights as a consumer.

8. App Store and Google Play terms

If you use Nowmark on an Apple device, Apple's Licensed Application End User License Agreement also applies. Where it conflicts with these terms, Apple's agreement applies to the extent of the conflict. Apple is not responsible for the app or its support. If you use Nowmark on Android, the Google Play Terms of Service also apply.

9. Our app

Nowmark, its design, name and code belong to The Apptor. We may update the app to fix problems, improve it or keep up with the platforms it runs on.

10. Changes to these terms

We may update these terms. When we do, we will change the effective date above. If a change matters to you, you can stop using the app and cancel your subscription. Continuing to use the app after a change means you accept it.

11. Liability

We provide Nowmark with reasonable care and skill. Apart from that, and to the extent the law allows, the app is provided "as is", and we are not responsible for:

  • losses that were not foreseeable when you started using the app;
  • business losses, such as lost profit, lost contracts or disputes with clients;
  • photos or data lost from your device, or decisions made on the strength of a stamp;
  • wrong times, places or addresses caused by your phone, its settings or the platform's location and address services.

Our total liability to you is limited to the amount you paid for Nowmark Pro in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your statutory rights as a consumer.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you can also bring a claim in your local courts and keep the protection of your local consumer law.
